Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the Revafone platform ("Service"), operated by Annex Media ("we", "us", or "Revafone"). By creating an account or using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

2. What Revafone does

Revafone is an AI-powered voice receptionist platform. It answers incoming phone calls on your behalf, qualifies leads, takes messages, and books appointments using AI conversation. The Service connects to third-party telephony, AI, and payment providers to deliver its features.

3. Your account

You must provide accurate information when creating an account. You are responsible for keeping your password and credentials secure, and for all activity on your account. Notify us promptly at hello@revafone.online if you suspect unauthorised access.

You must be at least 18 years old and have legal authority to bind the business you are signing up on behalf of.

4. Acceptable use

You agree NOT to use the Service to:

  • Make or facilitate unsolicited telemarketing, robocalls, or calls that violate the Spam Act 2003 (AU), TCPA (US), DNCR rules, or any equivalent laws in your jurisdiction.
  • Impersonate any person or organisation, or misrepresent your affiliation with one.
  • Record calls in violation of two-party consent laws or any other applicable recording-disclosure requirement.
  • Send or solicit fraudulent, harassing, threatening, defamatory, obscene, or illegal content.
  • Attempt to reverse engineer, decompile, or bypass the technical limits of the Service.
  • Scrape, mass-download, or otherwise extract data from the Service beyond ordinary use.
  • Resell or sublicense the Service without our written permission.
  • Use the Service in ways that violate any law or harm Revafone, our users, or third parties.

We may suspend or terminate accounts that violate these rules, with or without notice depending on severity.

5. Subscription and billing

Paid features are billed in advance on a recurring monthly or annual basis through Stripe. Usage-based charges (per-minute call usage above plan limits) are billed at the end of each billing period.

Subscriptions auto-renew unless cancelled before the renewal date. You can cancel at any time from the billing settings in your dashboard. Cancellation takes effect at the end of your current billing period — we do not refund partial periods unless required by law.

We may change pricing with at least 30 days' notice via email. Continued use after the change means you accept the new pricing.

6. Your content and data

You retain ownership of all content you upload to the Service (call recordings, transcripts, business information, custom audio). You grant Revafone a non-exclusive licence to host, process, and transmit your content solely to provide the Service. We do not use your content to train AI models.

You are responsible for the legality of the content you upload and for ensuring you have rights to use any audio files you upload (e.g. licensed music, voice talent).

7. Service availability

We aim for high availability but do not guarantee uninterrupted service. The Service may be unavailable due to maintenance, technical issues, or failures of third-party providers (telephony, AI, hosting). We are not liable for downtime caused by such factors.

We do not offer a formal Service Level Agreement (SLA) on standard plans. Enterprise customers may have separate written SLAs.

8. Intellectual property

Revafone, the Revafone logo, the Service, and all related software, designs, and documentation are the property of Annex Media. You may not copy, modify, distribute, or create derivative works based on them. You are granted a limited, non-transferable licence to use the Service in accordance with these Terms.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Service will be error-free, secure, or meet your specific requirements. AI-generated responses may contain errors — you are responsible for reviewing the AI's output and decisions.

10. Limitation of liability

To the maximum extent permitted by law, Revafone and Annex Media will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profit, revenue, data, or goodwill, arising out of your use of the Service.

Our total aggregate liability for any claim arising under these Terms is limited to the amount you have paid us for the Service in the 12 months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under Australian Consumer Law.

11. Indemnification

You agree to indemnify and hold harmless Annex Media, its officers, employees, and contractors from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms or any law.

12. Termination

You may stop using the Service and cancel your subscription at any time from your dashboard. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that exposes us or others to legal risk. On termination, your right to use the Service ends and we may delete your data after a reasonable retention period (see our Privacy Policy).

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email and posted here with a new "last updated" date. Continued use of the Service after a change means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria, Australia, unless required otherwise by law.
